Welcome to Scrap.Trade (“ScrapTrade,” “we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your access to and use of our website, app, and related services. By accessing or using the platform, you agree to these Terms. If you do not agree, please do not use the platform.

1. INTRODUCTION AND ACCEPTANCE
1.1 Agreement to Terms
These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User”, “you”, or “your”) and ScrapTrade.com.au (Mobeius Technologies Pty Ltd ABN: 49693656932, “we”, “us”, “our”, or “Platform”) governing your access to and use of the ScrapTrade.com.au website, mobile applications, and related services (collectively, the “Service”).
1.2 Acceptance
By accessing, browsing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and all applicable laws and regulations. If you do not agree to these Terms, you must immediately cease using the Service.
1.3 Amendments
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Service. Your continued use of the Service following the posting of changes constitutes acceptance of those changes. We will make reasonable efforts to notify Users of material changes via email or prominent notice on the Service.
1.4 Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any consumer rights under the Australian Consumer Law (“ACL”) contained in the Competition and Consumer Act 2010 (Cth) or any other applicable legislation that cannot be excluded, restricted, or modified by agreement.
2. MARKETPLACE & NON-PARTICIPATION DISCLAIMER
ScrapTrade operates solely as an online marketplace that provides a digital platform for independent third parties to list, discover, and connect for the potential trade of scrap materials.
ScrapTrade does not:
- – Buy, sell, trade, broker, or deal in scrap materials
- – Act as an agent, intermediary, or representative of any user
- – Take ownership, custody, possession, or control of any scrap
- – Arrange or provide transport, storage, inspection, handling, or processing services
- – Set prices, negotiate terms, or verify listings or transactions
All transactions occur directly between buyers and sellers. Any agreement, exchange, or dispute arising from a transaction is strictly between the parties involved.
ScrapTrade is not a party to any transaction and accepts no liability for the quality, legality, origin, condition, delivery, payment, or regulatory compliance of any materials listed or traded through the platform.
3. DEFINITIONS
“Business Day” means a day that is not a Saturday, Sunday, or public holiday in New South Wales, Australia.
“Buyer” means a User who purchases or seeks to purchase scrap metal or related materials through the Service.
“Content” means all information, data, text, images, photographs, videos, audio, software, and other materials available on or through the Service.
“Listing” means any advertisement, offer, or posting for scrap metal or related materials placed on the Service.
“Seller” means a User who offers for sale or sells scrap metal or related materials through the Service.
“Transaction” means any purchase, sale, or exchange of scrap metal or related materials between Users facilitated by the Service.
“User Content” means any Content submitted, posted, or transmitted by Users through the Service.
4. ELIGIBILITY AND REGISTRATION
4.1 Eligibility Requirements
To use the Service, you must:
- a) Be at least 18 years of age;
- b) Have the legal capacity to enter into binding contracts under Australian law;
- c) If representing a business, have the authority to bind that entity to these Terms;
- d) Not be prohibited from using the Service under Australian law or any other applicable jurisdiction;
- e) Hold all necessary licenses, permits, and registrations required for dealing in scrap metal in your jurisdiction, including but not limited to second-hand dealer licenses where applicable.
4.2 Account Registration
To access certain features of the Service, you must create an account by providing accurate, current, and complete information including:
- a) Full legal name (individual or business);
- b) Australian Business Number (ABN) for business entities;
- c) Valid email address and telephone number;
- d) Physical business address;
- e) Relevant licenses and permits;
- f) Banking details for payment processing (if applicable).
4.3 Account Security
You are responsible for:
- a) Maintaining the confidentiality of your account credentials;
- b) All activities that occur under your account;
- c) Immediately notifying us of any unauthorized use or security breach;
- d) Ensuring you log out from your account at the end of each session.
4.4 Account Verification
We reserve the right to:
- a) Verify your identity and business credentials;
- b) Request additional documentation to confirm compliance with legal requirements;
- c) Suspend or terminate accounts that fail verification;
- d) Conduct ongoing verification checks at our discretion.
4.5 One Account Per User
You may only maintain one active account. Creating multiple accounts or using another User’s account without permission is prohibited and may result in termination of all associated accounts.
5. USE OF THE SERVICE
5.1 License
Subject to these Terms, we grant you a limited, non-exclusive, nontransferable, revocable license to access and use the Service for lawful business purposes related to scrap metal trading.
5.2 Permitted Uses
The Service may be used only for:
- a) Listing scrap metal and related materials for sale;
- b) Purchasing scrap metal and related materials;
- c) Communicating with other Users regarding legitimate Transactions;
- d) Accessing market information and data provided by the Service.
5.3 Prohibited Uses
You must not:
- a) Use the Service for any unlawful purpose or in violation of these Terms;
- b) Impersonate any person or entity or falsely state or misrepresent your affiliation with any person or entity;
- c) Interfere with or disrupt the Service or servers or networks connected to the Service;
- d) Attempt to gain unauthorized access to any portion of the Service or any other systems or networks;
- e) Use any automated means (including bots, scripts, or web scraping) to access the Service without our express written permission;
- f) Transmit any viruses, malware, or other malicious code;
- g) Collect or harvest any information about Users without their consent;
- h) Engage in any conduct that restricts or inhibits any other User from using or enjoying the Service;
- i) Use the Service to facilitate stolen goods, illegal materials, or prohibited substances;
- j) Violate any applicable local, state, national, or international law or regulation;
- k) Engage in price fixing, market manipulation, or anti-competitive conduct;
- l) Circumvent any technological measures we use to protect the Service;
- m) Remove, obscure, or alter any legal notices displayed on the Service.
5.4 Compliance with Laws
You are solely responsible for ensuring that your use of the Service complies with all applicable laws, including but not limited to:
- a) Environmental protection legislation;
- b) Workplace health and safety requirements;
- c) Second-hand dealer and scrap metal dealer licensing requirements;
- d) Tax obligations including GST and income tax;
- e) Anti-money laundering and counter-terrorism financing laws;
- f) Competition and consumer protection laws;
- g) Export control regulations where applicable.
6. LISTINGS AND TRANSACTIONS
6.1 Creating Listings
When creating a Listing, you must:
- a) Provide accurate, complete, and current information about the materials offered;
- b) Use clear, representative photographs of the actual materials;
- c) Specify accurate weights, grades, and condition;
- d) Disclose any contaminants, hazardous materials, or special handling requirements;
- e) Set a fair and accurate price or price range;
- f) Comply with all applicable laws regarding the sale of scrap metal;
- g) Ensure you have legal ownership or authority to sell the listed materials.
6.2 Prohibited, Restricted & Illegal Materials Policy
The following materials are strictly prohibited from being listed, offered, requested, or traded through the platform:
❌ Stolen or Unlawfully Obtained Goods
- – Stolen scrap or property
- – Scrap derived from theft, unlawful removal, or criminal activity
- – Goods subject to police investigation, seizure, or ownership dispute
❌ Illegal Drugs & Controlled Substances
- – Narcotics, controlled drugs, precursors, or substances regulated under Australian drug laws
- – Any materials contaminated by illegal substances
❌ Hazardous, Dangerous & Regulated Materials
- – Hazardous waste, dangerous goods, or controlled waste
- – Materials containing asbestos, radioactive substances, or toxic chemicals
- – Explosives, ammunition, weapons, or weapon components
❌ Any Other Illegal or Restricted Items
- – Materials indicating unlawful origin or prohibited trade
- – Items restricted or prohibited under Commonwealth, state, or territory law
Users are solely responsible for verifying the lawful origin, classification, handling, transport, and disposal of any materials listed or traded.
ScrapTrade reserves the right to remove listings, suspend accounts, or restrict access where prohibited or unlawful materials are suspected, without notice or liability.
6.3 Listing Accuracy
You represent and warrant that:
- a) All information in your Listings is true, accurate, and not misleading;
- b) You have the legal right to sell the materials listed;
- c) The materials are not stolen property;
- d) The materials comply with all applicable environmental and safety standards;
- e) You will honor all Listings until they are withdrawn or expire.
6.4 Pricing and Availability
- a) Prices must be stated in Australian Dollars (AUD) unless otherwise agreed;
- b) Prices should clearly indicate whether GST is included;
- c) You must promptly update or remove Listings when materials are sold or no longer available;
- d) We reserve the right to remove Listings with inaccurate pricing or availability.
6.5 Transaction Process
- a) The Platform facilitates connections between Buyers and Sellers but is not a party to Transactions;
- b) Buyers and Sellers are responsible for negotiating and completing Transactions independently;
- c) All Transaction terms (including price, payment method, delivery, inspection rights) must be agreed between the parties;
- d) We recommend documenting all Transaction terms in writing.
6.6 Payment and Delivery
- a) Payment terms are agreed directly between Buyer and Seller;
- b) We may provide optional payment processing services (subject to separate terms);
- c) Delivery, collection, and freight arrangements are the responsibility of the transacting parties;
- d) Risk passes according to the agreed terms between Buyer and Seller;
- e) Title to materials passes according to Australian law and the agreed terms.
6.7 Inspection Rights
- a) Buyers should inspect materials before purchase where reasonably practicable;
- b) Sellers should provide reasonable opportunities for inspection;
- c) Materials should conform to Listing descriptions upon inspection;
- d) Discrepancies should be raised and resolved between the parties prior to completion.
6.8 Disputes Between Users
- a) Transaction disputes are between the Buyer and Seller;
- b) We may provide dispute resolution assistance but are not obligated to do so;
- c) We reserve the right to investigate disputes and take appropriate action;
- d) Persistent disputes or fraudulent conduct may result in account suspension or termination.
7. PLATFORM ADMINISTRATION & CONTENT MODERATION
ScrapTrade reserves the absolute right, at its sole discretion and without prior notice, to review, approve, reject, edit, restrict, suspend, or remove any user account, listing, content, or activity on the platform.
This includes, but is not limited to, actions taken where ScrapTrade reasonably believes that a listing or account:
- – Violates these Terms and Conditions
- – Involves prohibited, restricted, or unlawful materials
- – May breach applicable Commonwealth, state, or territory laws
- – Poses legal, regulatory, reputational, or operational risk
- – Is misleading, inaccurate, incomplete, or inappropriate
ScrapTrade is under no obligation to provide reasons for any moderation action and accepts no liability for any loss, delay, or impact arising from the approval, rejection, suspension, or removal of any account or listing.
7.1 No Obligation to Monitor
ScrapTrade does not guarantee the review, approval, or ongoing monitoring of listings or user activity. Any moderation or administrative action taken does not constitute verification, endorsement, or acceptance of responsibility for any listing or transaction.
8. FEES AND PAYMENT
8.1 Service Fees
We may charge fees for:
- a) Listing creation and enhancement;
- b) Transaction commissions;
- c) Premium features and subscriptions;
- d) Data and analytics services;
- e) Other value-added services.
8.2 Fee Structure
- a) Current fees are published on the Service and may be updated from time to time;
- b) We will provide reasonable notice of fee changes;
- c) All fees are in Australian Dollars and are exclusive of GST unless stated otherwise;
- d) Continued use of the Service after fee changes constitutes acceptance.
8.3 Payment Terms
- a) Fees are payable when invoiced or as otherwise specified;
- b) Payment must be made by approved methods (credit card, direct debit, bank transfer);
- c) You authorize us to charge your designated payment method for all fees;
- d) Outstanding fees may result in suspension or termination of Service access.
8.4 GST
- a) Where applicable, GST will be added to fees at the prevailing rate;
- b) Tax invoices will be provided in accordance with Australian tax law;
- c) You are responsible for all applicable taxes on your Transactions.
8.5 No Refunds
Fees are generally non-refundable except:
- a) Where required by the Australian Consumer Law;
- b) At our sole discretion in exceptional circumstances;
- c) Where we fail to provide the Service as promised.
9. INTELLECTUAL PROPERTY
9.1 Platform Ownership
All intellectual property rights in the Service, including but not limited to software, design, text, graphics, logos, trademarks, service marks, and other Content (excluding User Content) are owned by or licensed to us and are protected by Australian and international intellectual property laws.
9.2 Limited License
These Terms do not transfer any ownership rights. We grant you only a limited license to use the Service as expressly permitted by these Terms.
9.3 User Content License
By submitting User Content to the Service, you grant us a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content for the purposes of operating, promoting, and improving the Service.
9.4 User Content Warranties
You represent and warrant that:
- a) You own or have the necessary rights to submit User Content;
- b) Your User Content does not infringe any third-party intellectual property rights;
- c) You have obtained all necessary permissions and consents;
- d) Your User Content complies with these Terms and applicable laws.
9.5 Prohibited Content
User Content must not:
- a) Infringe intellectual property rights of any third party;
- b) Contain false, misleading, or deceptive information;
- c) Be defamatory, obscene, offensive, or inappropriate;
- d) Contain malware or malicious code;
- e) Violate any person’s privacy or publicity rights;
- f) Promote illegal activities or products.
9.6 Content Moderation
We reserve the right to:
- a) Monitor, review, and moderate User Content;
- b) Remove or refuse to publish any User Content at our discretion;
- c) Take action against Users who violate these Terms;
- d) Cooperate with law enforcement and regulatory authorities.
9.7 Trademark Usage
You may not use our trademarks, service marks, logos, or branding without our prior written consent. Unauthorized use may constitute trademark infringement.
10. PRIVACY AND DATA PROTECTION
10.1 Privacy Policy
Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference and available at official Websites.
10.2 Consent to Data Collection
By using the Service, you consent to our collection, use, storage, and disclosure of your personal information in accordance with our Privacy Policy and the Privacy Act 1988 (Cth).
10.3 User Data Responsibilities
You are responsible for:
- a) Protecting the privacy of individuals whose information you collect through the Service;
- b) Complying with the Privacy Act 1988 (Cth) and Australian Privacy Principles;
- c) Obtaining necessary consents for data collection and use;
- d) Securing personal information against unauthorized access.
10.4 Data Security
While we implement reasonable security measures, you acknowledge that:
- a) No internet transmission is completely secure;
- b) We cannot guarantee absolute security of data;
- c) You use the Service at your own risk regarding data security.
11. THIRD-PARTY SERVICES AND LINKS
11.1 Third-Party Services
The Service may integrate with or link to third-party services, websites, or applications (“Third-Party Services”). We are not responsible for:
- a) The availability, accuracy, or content of Third-Party Services;
- b) The privacy practices of Third-Party Services;
- c) Any transactions or interactions with Third-Party Services;
- d) Any loss or damage arising from your use of Third-Party Services.
11.2 Third-Party Terms
Your use of Third-Party Services is subject to their respective terms and conditions. We recommend reviewing such terms before use.
11.3 No Endorsement
Links to Third-Party Services do not constitute endorsement, approval, or recommendation by us.
12. WARRANTIES AND REPRESENTATIONS
12.1 Your Warranties
You represent and warrant that:
- a) You have the legal capacity and authority to enter into these Terms;
- b) Your use of the Service complies with all applicable laws;
- c) All information you provide is true, accurate, current, and complete;
- d) You hold all necessary licenses and permits for your activities;
- e) You will not use the Service for any unlawful purpose;
- f) Your User Content does not violate any third-party rights.
12.2 Platform Disclaimers
To the maximum extent permitted by law:
- a) The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied;
- b) We disclaim all warranties including but not limited to merchantability, fitness for a particular purpose, and noninfringement;
- c) We do not warrant that the Service will be uninterrupted, errorfree, secure, or free from viruses;
- d) We do not warrant the accuracy, completeness, or reliability of Content;
- e) We do not guarantee any specific results from using the Service.
12.3 No Responsibility for Transactions
We expressly disclaim responsibility for:
- a) The quality, safety, legality, or accuracy of materials listed;
- b) The ability of Sellers to complete sales or Buyers to complete purchases;
- c) Payment defaults or delivery failures;
- d) Disputes between Users;
- e) Misrepresentations by Users;
- f) Compliance with applicable laws by Users.
12.4 Verification of Users
While we may verify certain User information, we do not:
- a) Guarantee the accuracy of User-provided information;
- b) Conduct comprehensive background checks on all Users;
- c) Verify the legal status or creditworthiness of Users;
- d) Endorse or recommend any User.
12.5 Australian Consumer Law Rights
Nothing in these Terms excludes, restricts, or modifies any consumer guarantees, warranties, or other rights you may have under the Australian Consumer Law or other applicable legislation that cannot be excluded, restricted, or modified by agreement.
Where the Australian Consumer Law applies and we are liable for a failure to comply with a consumer guarantee:
- a) For goods, our liability is limited (at our option) to replacement, repair, or payment of the cost of replacement or repair;
- b) For services, our liability is limited to supplying the services again or payment of the cost of having the services supplied again.
This limitation does not apply to consumer guarantees that cannot be limited under the Australian Consumer Law.
13. LIMITATION OF LIABILITY
13.1 Exclusion of Liability
To the maximum extent permitted by Australian law, we shall not be liable for:
- a) Any indirect, incidental, special, consequential, or punitive damages;
- b) Loss of profits, revenue, data, or goodwill;
- c) Service interruptions or delays;
- d) Unauthorized access to or alteration of User Content;
- e) Statements or conduct of any User or third party;
- f) Any matter beyond our reasonable control.
13.2 Maximum Liability
Where we cannot exclude liability, our total aggregate liability to you for all claims arising from or related to these Terms or the Service shall not exceed the greater of:
- a) The fees paid by you to us in the 12 months preceding the claim; or
- b) AUD $1,000.
13.3 Australian Consumer Law
Nothing in this Section excludes, restricts, or modifies any consumer guarantees, warranties, or other rights you may have under the Australian Consumer Law or other applicable legislation that cannot be excluded, restricted, or modifiedby agreement.
13.4 User Responsibility
You acknowledge and agree that:
- a) You use the Service at your own risk;
- b) You are solely responsible for your interactions with other Users;
- c) You should exercise caution and good judgment in all Transactions;
- d) We are not a party to disputes between Users.
14. INDEMNIFICATION
14.1 Your Indemnity
You agree to indemnify, defend, and hold harmless ScrapTrade.com.au, its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable legal fees) arising from or relating to:
- a) Your use or misuse of the Service;
- b) Your violation of these Terms;
- c) Your violation of any law or regulation;
- d) Your User Content;
- e) Your infringement of any third-party rights, including intellectual property rights;
- f) Any Transaction conducted through the Service;
- g) Any dispute between you and another User;
- h) Your negligent or willful misconduct;
- i) Breaches of applicable laws or regulations;
- j) Listings or transactions involving prohibited or illegal materials;
- k) Failure to comply with state or territory compliance obligations.
14.2 Defense of Claims
We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with us in asserting any available defenses.
15. TERMINATION AND SUSPENSION
15.1 Termination by You
You may terminate your account at any time by:
- a) Providing written notice to us via email at cs@scraptrade.com.au.
- b) Following the account termination process on the Service;
- c) Ceasing all use of the Service.
15.2 Termination by Us
We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:
- a) Violation of these Terms;
- b) Fraudulent, deceptive, or illegal activity;
- c) Failure to pay fees when due;
- d) Receipt of complaints from other Users;
- e) Court order or legal requirement;
- f) Discontinuation or material modification of the Service;
- g) Inactivity for an extended period;
- h) Risk to the security or integrity of the Service.
15.3 Effect of Termination
Upon termination:
- a) Your right to access and use the Service immediately ceases;
- b) We may delete your account and User Content;
- c) Outstanding fees become immediately due and payable;
- d) You remain liable for all obligations incurred prior to termination;
- e) Sections that by their nature should survive termination will remain in effect.
15.4 No Refunds on Termination
Termination does not entitle you to a refund of any fees except as required by the Australian Consumer Law.
15.5 Survival
The following provisions survive termination: Intellectual Property, Privacy, Warranties, Limitation of Liability, Indemnification, Governing Law, and Dispute Resolution.
16. DISPUTE RESOLUTION
16.1 Informal Resolution
Before initiating formal dispute resolution, you agree to first contact us at cs@scraptrade.com.au to attempt to resolve any dispute informally. We will make good faith efforts to resolve disputes amicably within 30 days.
16.2 Negotiation
If informal resolution fails, the parties agree to negotiate in good faith for a further 30 days before commencing formal proceedings.
16.3 Mediation
If negotiation does not resolve the dispute, either party may refer the matter to mediation administered by a recognized mediation service provider in New South Wales, with costs shared equally unless otherwise agreed.
16.4 Governing Law and Jurisdiction
These Terms are governed by the laws of New South Wales, Australia. The parties submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia for any disputes arising from or relating to these Terms or the Service.
16.5 Class Action Waiver
To the extent permitted by law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not as a class action or representative action.
17. GENERAL PROVISIONS
17.1 Entire Agreement
These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements and understandings.
17.2 Waiver
No waiver of any provision of these Terms shall be deemed a further or continuing waiver of that provision or any other provision. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
17.3 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. Invalid provisions shall be modified to the minimum extent necessary to make them valid and enforceable while preserving the original intent.
17.4 Assignment
You may not assign, transfer, or delegate these Terms or your rights and obligations hereunder without our prior written consent. We may freely assign, transfer, or delegate these Terms and our rights and obligations without restriction.
17.5 No Agency
Nothing in these Terms creates any partnership, joint venture, employment, or agency relationship between you and us. You have no authority to bind us or make commitments on our behalf.
17.6 Force Majeure
We shall not be liable for any failure or delay in performing obligations under these Terms due to causes beyond our reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, labor disputes, internet or telecommunications failures, government actions, or natural disasters.
17.7 Notices
All notices under these Terms must be in writing and sent to:

Notices to you may be sent to the email address associated with your account and shall be deemed received 24 hours after sending.
17.8 Electronic Communications
You consent to receive communications from us electronically, including via email or by posting notices on the Service. You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.
17.9 Language
These Terms are drafted in English. If translated, the English version prevails in case of any inconsistency or different interpretation.
17.10 Headings
Section headings are for convenience only and do not affect interpretation of these Terms.
17.11 Third-Party Rights
These Terms do not confer any rights or remedies upon any person other than the parties to these Terms, except as expressly provided.
18. COMPLIANCE AND REGULATORY MATTERS
18.1 Australian Legal & Regulatory Compliance
Buyers and sellers are solely responsible for ensuring that all listings, transactions, and activities comply with all applicable Commonwealth, state, and territory laws, including but not limited to scrap metal, second-hand goods, environmental protection, dangerous goods, and criminal legislation.
This includes compliance with all licensing, identification, record-keeping, reporting, and verification obligations applicable in the user’s state or territory.
ScrapTrade does not verify, monitor, or enforce user compliance and makes no representations regarding the legality of any transaction conducted through the platform.
18.2 Scrap Metal Dealer Obligations
Users dealing in scrap metal must comply with all applicable state and territory legislation, including but not limited to:
- a) Second-hand dealer licensing requirements;
- b) Record-keeping obligations;
- c) Reporting of suspicious transactions;
- d) Restrictions on cash transactions;
- e) Proof of identity verification requirements.
18.3 Environmental Compliance
Users must comply with all environmental laws and regulations, including:

Users are responsible for ensuring all activities comply with:

- b) State and territory WHS legislation;
- c) Safe work method statements;
- d) Appropriate safety equipment and procedures.
18.5 Anti-Money Laundering
Users must comply with:
- a) Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth);
- b) Suspicious matter reporting obligations;
- c) Customer due diligence requirements;
- d) Transaction monitoring and record-keeping.
18.6 Competition Law
Users must not engage in conduct that violates the Competition and Consumer Act 2010 (Cth), including:
- a) Price fixing or market allocation;
- b) Bid rigging or collusive tendering;
- c) Misuse of market power;
- d) Anti-competitive agreements.
18.7 Export Controls
Users exporting scrap metal must comply with:
- a) Customs Act 1901 (Cth);
- b) Export control regulations;
- c) International trade sanctions;
- d) Destination country requirements.
