The hiring agreement
A scrap agent hiring agreement checklist
When you hire an agent on ScrapTrade, the hiring agreement records the essentials and stays on record. Check each of these before you confirm. This is general guidance, not legal advice, and you should have anything significant reviewed by a qualified adviser.
| What the agreement records | What to check |
|---|---|
| The hirer | That the right seller or buyer is named |
| The agent | That you have chosen the agent you intended |
| The commission | The percentage (default 5%, editable before you confirm). It is locked once you confirm |
| The scope | Which listing, transaction or period of work the agreement covers |
| The confirmation date | When the agreement was confirmed, which is when the rate becomes locked |
| The status | Whether the agreement is active, and what that means for deals already in progress |

Points beyond the agreement itself
| Topic | Why it matters |
|---|---|
| What the commission is calculated on | Check which amount the percentage applies to and which charges sit outside it |
| Cancellations, refunds and disputes | Check when the commission is payable if a deal does not complete |
| Platform charges and taxes | These are separate from the commission and appear in the payment breakdown |
| Who else the agent works for | An agent should tell you if they act for the other side of your deal |
| How you will be updated | Agree with the agent how and how often they report |
| Records | Keep your own copies of the agreement, the listings and the final deal breakdown |
Changing the terms
A new rate means a new agreement
The commission cannot be edited once the agreement is confirmed. If you and the agent want a different rate, a new agreement is needed, and the original stays on record. Check the percentage carefully before you confirm.
